Irony is a funny thing… Life is full of little twists that from an outside view can be rather comical. As Quantum, a no win no fee accident claims service which provides help for those looking to make a claim against their employers for work related accidents, recently found out. They found themselves on the other side of the claim, as the defendant, when one of their employees 56 year old Rose Clark from Aberdeen made a claim against them after suffering an injury on the job in March of 2007.

Rose’s injuries were so serious she had to have surgically fitted plates in her wrist in order to recover from the fall. She claims the employer is to be held responsible, as the staircase in her workplace did not have suitable banisters, and was “too steep and narrow.” She was claiming for £13,500 compensation from Quantum at Edinburgh’s Court of Session.


Rose explained how the colleague who spoke to her as she woke from her injury suspected that she had broken her neck due to the way she was lying. Following the incident a council inspector visited the offices and discovered that one of the steps had been loose at the time of the incident. Mrs Clark disagreed with claims by Quantum that the fall was caused by her high-heels catching on her trouser leg, saying that she would be fully aware if this was the case. The case is currently being heard by Lord Glennie and is awaiting a decision.
